Your sole remedy for any breach or default of this Agreement by the Website Owner shall be a return of any fees paid to the Website Owner for any services provided under this Agreement. - Do Not Rely on the Education Over Debt Foundation. Opinions, advice, statements, or other comments should not necessarily be relied upon and are not to be construed as professional advice from the Education Over Debt Foundation or Website Owner. The Website Owner does not guarantee the accuracy or completeness of any of the information provided and is not responsible for any loss resulting from your reliance on such information.
- Warning re: Offensive Information. It is possible that hackers and other third-parties, outside of the control of the Education Over Debt Foundation, may steal and use your information to send you fraudulent and offensive information. The Education Over Debt Foundation, its employees, agents, affiliates, licensees, and web hosting services are not responsible for these transmissions or for the release of such information by others about you.
- Right to Monitor. The Education Over Debt Foundation website contains links to its social media channels. We reserve the right, but are not obligated, to monitor materials posted on our website and any of our social media pages and shall have the right to remove any information deemed offensive by our staff. Notwithstanding the foregoing, you remain solely responsible for your use of any information contained on the site.
- Media Release. - It is agreed that all personal information given to us, will be kept confidential, with the following exceptions: (2) you actively chose to post your personal information for others to see; (3) you send a message to another client in our program, who discloses your personal information; (3) we receive a legal request or subpoena from any legal entity, court, agency or organization, requesting the disclosure of your personal information and the disclosure is required by law or (4) you have harassed another person via any service provided by the Education Over Debt Foundation in which case the confidentiality clause contained in this Agreement is rendered null and void.
- Ownership, Copyrights, Trademarks, Licenses. The Education Over Debt Foundation owns and retains all proprietary rights to this website, its trademarks, and copyrights. Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information of the Education Over Debt Foundation.
- No Warranties. The Education Over Debt Foundation provides this website and services on an “as is” basis and does not make any warranty, express, implied, limited, or other with respect to the services provided. Specifically, the Education Over Debt Foundation does not warrant that the website and service it provides will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected.
- This Agreement or any dispute arising from this Agreement is governed by the laws of North Carolina, without regard to provisions of conflicts of law. Any lawsuit arising from or related to this Agreement shall be brought exclusively before in Mecklenburg County, North Carolina. By using this website, you hereby consent to the jurisdiction of any such court.
- If any provision is found to be invalid, the remaining provisions will be in full force and effect.
- You certify that you are at least 18 years of age, and that this website is being accessed by your own free will. By accessing and using this website, you understand and agree that basic information concerning you, given to us, will be used by our company, its board of directors, officers, and affiliates to evaluate education and financial resources relevant to your growth and success. - The failure of us to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by us must be in writing and signed by an authorized representative of the Website Owner.
